BALKANIKA reserves the right not to publish a participatory financing request (funding offer) on its platform in cases such as, but not limited to, situations where the proposed offer or project does not comply with applicable regulations, including those related to the protection of trade secrets, the prevention of money laundering, the fight against terrorist financing, or the protection of personal data.

Users of the Platform may contact the Data Protection Officer directly at any time regarding any issues related to this Policy, using the contact details provided on the Platform.

Outsourcing is not part of BALKANIKA’s operations; however, to ensure the efficient functioning of the Platform, we use banking services where some of the confidential and personal data collected from you may be used, provided that sufficient guarantees are offered to implement appropriate technical and organizational measures. These measures ensure that processing complies with the requirements outlined in this Policy and the Platform Rules and guarantees the protection of your rights, including the management and security of confidential, personal, or sensitive information.

The following data is collected and processed: Email address; First and last name; Personal identification number (IDNP); Date, month, and year of birth; Phone number; Address; Any other data that the legislation of the Republic of Moldova classifies as personal, sensitive, confidential, or trade secrets.

BALKANIKA retains confidential data for various periods, deemed necessary in accordance with legal or reasonable requirements, in line with the purposes outlined above. This includes the obligation to retain documentation for at least five (5) years from the termination of the business relationship.

Confidential data provided by you will be processed throughout the duration of your contractual relationship with BALKANIKA and beyond, for a period necessary in accordance with legal or reasonable requirements, in line with the purposes outlined above.

You have the right to obtain confirmation from BALKANIKA as to whether your confidential data is being processed and to access this data. You may also request a copy of the confidential data provided to BALKANIKA and processed by it. For any additional copies requested, BALKANIKA may charge a reasonable fee based on administrative costs. The information will be provided in a commonly used electronic format.

You have the right to request: Correction of inaccurate confidential data; ​Completion of incomplete confidential data

BALKANIKA will inform each recipient to whom confidential data has been disclosed about any corrections, unless this proves impossible or requires disproportionate efforts. If requested, BALKANIKA will provide information about these recipients.

Due to the regulatory obligation imposed by the supervisory authority requiring BALKANIKA to retain documentation, including the Transaction Record Register, for a period of at least five (5) years from the termination of the business relationship, the right to request the deletion of confidential data without undue delay is subject to compliance with this regulatory obligation.

Under the regulatory obligation imposed on BALKANIKA to retain documentation for at least 5 years from the termination of the business relationship, you have the right to request the deletion of your confidential data without undue delay, and BALKANIKA is obligated to delete such data when:

1. The confidential data is no longer necessary for the purposes for which it was collected or processed;
2. You withdraw the consent upon which the processing is based, and there is no other legal basis for processing;
3. You object to the processing, and there are no legitimate grounds that override your objection;
4. The confidential data has been processed unlawfully;
5. The confidential data must be deleted to comply with a legal obligation imposed on BALKANIKA.

Upon request, BALKANIKA will inform each client whose confidential data has been accessed about the circumstances, reasons, and the parties who accessed it.

You have the right to request the restriction of the processing of your data if you find yourself in any of the following situations:

1. You contest the accuracy of the data, for the period during which you allow BALKANIKA to verify the accuracy of the data;
2. The processing is unlawful, and you oppose the deletion of the confidential data, requesting instead the restriction of its use;
3. BALKANIKA no longer needs the confidential data for processing, but you require it to establish, exercise, or defend a legal claim;
4. You have objected to the processing while the period is pending to determine whether BALKANIKA's legitimate rights override your own.

BALKANIKA will inform each recipient to whom confidential data has been disclosed about any restriction on processing, unless this proves impossible or requires disproportionate efforts. You will also be informed about these recipients if you request such information.

You have the right to receive your confidential data, as provided to BALKANIKA, in a structured, commonly used, and machine-readable format. You have the right to have your data transmitted directly when technically feasible.

You have the right to object, at any time and for reasons related to your particular situation, to the processing of your confidential data, including the creation of profiles based on such data. You also have the right not to be subject to decisions based solely on automated processing, including profiling. Additionally, you have the right to file a complaint with the competent public authorities, including the supervisory authority.

You have the right to withdraw your consent at any time, without affecting the legality of the processing carried out by BALKANIKA based on the consent prior to its withdrawal.

The purpose of the technical and organizational measures for data processing is to protect your confidential data from unauthorized access, improper use or disclosure, unauthorized modification, destruction, or accidental loss. All employees of BALKANIKA are obligated to respect the confidentiality of your information, in accordance with this Policy and the Platform Rules. Platform users (clients) are also required to maintain the confidentiality of all information they come into contact with during their interactions with BALKANIKA, other users, or any third parties, and they are not permitted to disclose it without prior written consent from BALKANIKA.

BALKANIKA informs interested parties of this Policy to ensure the proper management of confidential data and information received from investors, the fraud prevention policy, and privacy/data protection practices, as well as the locations, methods, and policies for archiving documents. BALKANIKA does not use cloud technologies.

Regarding record-keeping and archiving, BALKANIKA keeps records of documents in accordance with applicable legislation, in a format that ensures the security, integrity, and confidentiality of the data. Documentation may be stored electronically or physically at BALKANIKA's headquarters, in compliance with all legal requirements regarding data protection. These records are accessible to the supervisory authority, audit entities, or other competent bodies in accordance with applicable legislation. Records, including archived ones, are stored in a way that allows for quick and accurate verification of information. Electronic documents are protected using appropriate cybersecurity measures, including encryption and access control. In the case of paper documents, they are kept in conditions that prevent deterioration, loss, or unauthorized access at BALKANIKA's premises.

BALKANIKA protects the confidentiality and security of all confidential data to which it has access and ensures the use of this information solely for the purposes of executing contracts and other conditions expressly provided by applicable legislation. We remind you that, as a Client, you are obligated to maintain the security of your account on the Platform, including using a unique password and keeping it confidential, as per the Platform's Rules of Use.

The contractual obligations regarding the non-disclosure of confidential information by the Client or their Client are essential and must be strictly observed by both contractual parties.

BALKANIKA is the exclusive owner of all intellectual property rights related to the content of the Platform. Users (clients, potential clients) of the Platform understand and agree that they will not use the previously mentioned materials in any way, except for the uses explicitly approved by BALKANIKA. No section of the Platform's content may be reproduced, distributed, or published in any form or by any means without the prior written consent of BALKANIKA. This means that Platform users understand and agree not to modify, sell, distribute, or create derivative works based on the Platform's content, in any way, without BALKANIKA's prior written consent.

Please note that this Policy may be periodically updated through changes to the website and the Platform's Rules of Use. Therefore, it is necessary to check this page for any updates.

We specify that your confidential data will be processed by BALKANIKA, following your acceptance of this Policy, and in accordance with it and the Platform's Rules. Please refrain from using the BALKANIKA Platform if you do not agree with this Policy.
